Sanders to Boswell
State of Georgia, Greene County.
This indenture made entered into this 10th day of March in the year of our Lord eighteen hundred and fifty-nine between James H. Sanders of the county and state aforesaid of the one part and Johnson Boswell of the same place of the other part. Witnesseth that the said James H. Sanders for and in consideration of the sum of four hundred and one dollars to him in hand paid at and before the sealing and delivered of these presents the receipt whereof is hereby acknowledged, hath bargained, sold, and conveyed and by these presents doth bargain, sell, grant, and convey unto the said Johnson Boswell for the use being and advantage in trust for Charlotte G. Spencer of said state and county wife of Benjamin E. Spencer free from the control or disposition of her present or future husband, a negro woman named Mary, about forty-five years of age, said negro woman to be free from the debts, liabilities, and control of her present or a future husband to have and to hold the aforesaid described negro woman to him the said Johnson Boswell in trust for Charlotte G. Spencer, wife of said Benjamin E. Spencer, for her own proper use and benefit and the said Charlotte G. Spencer may bequeath by will or thereby at her death dispose of the said negro woman Mary and should it become necessary and expedient at any future time to sell the said negro woman and to invest the proceeds thereof in other property the present trustee Johnson Boswell or any future trustee is hereby authorized and empowered by or with the consent of the said Charlotte G. Spencer the cestui que trust to make such sale and invest the proceeds arising therefrom as aforesaid and should Johnson Boswell, the present trustee, be removed by death or otherwise then the said Charlotte G. Spencer may select or choose for herself some other person to act as trustee the said James H. Sanders for himself, his executors, and administrators, the said bargained property unto the said Johnson Boswell, trustee, as aforesaid will warrant and defend by these presents against any person or persons whatever.

I, Johnson Boswell, hereby agree to act as trustee for Charlotte G. Spencer according to the term of the within deed of trust March 15, 1859.
